Ownership Of Site; Agreement To Terms Of Use
These Terms and Conditions of Use (the “Terms of Use”) apply to the MakeupStash.pk web site located at www.makeupstash.pk, and all associated sites linked to it by MakeupStash.pk, its subsidiaries and affiliates (if any), including MakeupStash.pk sites around the world, if any (collectively, the “Site”). The Site is the property of Makeup Stash (“Makeup Stash”) and its licensors. BY USING THE SITE, YOU AGREE TO THESE TERMS OF USE LAID OUT IN THEIR ENTIRETY BELOW; IF YOU DO NOT AGREE, DO NOT USE THE SITE.
Makeupstash.pk reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time. It is your responsibility to check these Terms of Use periodically for changes. Your continued use of the Site following the posting of changes will mean that you accept and agree to the changes. As long as you comply with these Terms of Use, Makeup Stash grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Site.

All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork and computer code (collectively, “Content”), including but not limited to the design, structure, selection, coordination, expression, “look and feel” and arrangement of such Content, contained on the Site is owned, controlled or licensed by or to Makeup Stash, whereas the trademarks, logos, artwork of products sold on the Site are the property of the respective owners of all such trademarks, logos, artworks, and is protected by trade dress, copyright, patent and trademark laws, and various other intellectual property rights and unfair competition laws.
Except as expressly provided in these Terms of Use, no part of the Site and no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including “mirroring”) to any other computer, server, Web site or other medium for publication or distribution or for any commercial enterprise, without Makeup Stash’s express prior written consent.

This website or any portion of this website (including but not limited to any copyrighted material, trademarks, or other proprietary information) may not be reproduced, duplicated, copied, sold, resold, visited, distributed or otherwise exploited for any commercial purpose without express written consent of Makeup Stash.
You may not frame or use framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Makeup Stash without express written consent. You may not use any meta tags or any other “hidden text” utilising Makeup Stash names or trademarks without the express written consent of Makeup Stash. Any unauthorised use terminates the permission or license granted by Makeup Stash.
You are granted a limited, revocable, and non-exclusive right to create a hyperlink to the home page of makeupstash.pk as long as the link does not portray Makeup Stash in a false, misleading, derogatory, or otherwise offensive matter. You may not use any Makeup Stash logo or other proprietary graphic or trademark as part of the link without express written consent of Makeup Stash.
You may not use any “deep-link”, “page-scrape”, “robot”, “spider” or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Site or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Site or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Site. Makeup Stash reserves the right to bar any such activity.
You may not attempt to gain unauthorized access to any portion or feature of the Site, or any other systems or networks connected to the Site or to any Makeup Stash server, or to any of the services offered on or through the Site, by hacking, password “mining” or any other illegitimate means.
You may not probe, scan or test the vulnerability of the Site or any network connected to the Site, nor breach the security or authentication measures on the Site or any network connected to the Site. You may not reverse look-up, trace or seek to trace any information on any other user of or visitor to the Site, or any other customer of Makeup Stash, including any Makeup Stash account not owned by you, to its source, or exploit the Site or any service or information made available or offered by or through the Site, in any way where the purpose is to reveal any information, including but not limited to personal identification or information, other than your own information, as provided for by the Site.

Access To The Site
We will do our utmost to ensure that availability of the website will be uninterrupted and that transmissions will be error-free. However, due to the nature of the Internet, this cannot be guaranteed. Also, your access to the website may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services at any time without prior notice. We will attempt to limit the frequency and duration of any such suspension or restriction.
Your Conduct
You must not use the Site in any way that causes, or is likely to cause, the Site or access to it to be interrupted, damaged or impaired in any way. - to cause annoyance, inconvenience or needless anxiety.
Reviews, Comments, Communications And Other Content
Users of this Site may post reviews, comments and other content; send communications; and submit suggestions, ideas, comments, questions, or other information, as long as the content is not illegal, obscene, abusive, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties, or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of “spam.” In the event a user uses a false e-mail address, impersonates any person or entity, or otherwise misleads as to the origin of any content, Makeup Stash reserves the right (but not the obligation) to remove, refuse, delete or edit any content that in the sole judgement of Makeup Stash violates these terms and conditions and, or terminate your permission to access or use this Site.
If you do post content or submit material, and unless we indicate otherwise, you
(a) grant Makeup Stash and its affiliates and sublicensees a non-exclusive, royalty-free, irrevocable, perpetual and fully sublicensable rights to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media; and
(b) Makeup Stash and its affiliates and sublicensees the right to use the name that you submit in connection with such content, if they choose.
You agree that the rights you grant above are irrevocable during the entire period of protection of your intellectual property rights associated with such content and material. You agree to waive your right to be identified as the author of such content and your right to object to derogatory treatment of such content. All software used on this website is the property of Makeup Stash, its affiliates or its software suppliers and is protected by the Islamic Republic of Pakistan and international copyright and author’ rights laws.
You may not systematically extract/ or re-utilise parts of the contents of the website without Makeup Stash and / or its affiliate’s (as may be applicable) express written consent. In particular, you may not utilise any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilisation of any substantial parts of this website, without Makeup Stash’s and / or its affiliate’s (as may be applicable) express written consent. Purchases; Other Terms And Conditions
Additional terms and conditions, such as those specified in the FAQs, may apply to purchases of goods or services and to specific portions or features of the Site, including contests, promotions or other similar features, all of which terms are made a part of these terms and conditions by this reference. You agree to abide by such other terms and conditions, including where applicable representing that you are of sufficient legal age to use or participate in such service or feature. Our Contract
Your order is an offer to us to buy the product(s) in your order. When you place an order to purchase a product from us, you will receive an e-mail confirming receipt of your order and containing the details of your order (the “Order Confirmation E-mail”). The Order Confirmation E-mail is acknowledgement that we have received your order, and does not confirm acceptance of your offer to buy the product(s) ordered. We only accept your offer, and conclude the contract of sale for a product ordered by you, when the product is dispatched to you and an e-mail confirmation is sent to you that the product has been dispatched to you (the “Dispatch Confirmation E-mail”). If your order is dispatched in more than one package, you may receive a separate Dispatch Confirmation E-mail for each package, and each Dispatch Confirmation E-mail and corresponding dispatch will conclude a separate contract of sale between you and us for the product(s) specified in that Dispatch Confirmation E-mail.
Your contract is with us (the Sellers) and you confirm that the product(s) ordered by you are purchased for your internal / personal purpose and not for re-sale. You authorize us to declare and provide declaration to any governmental authority on your behalf stating the aforesaid purpose of the products ordered by you on the website.
You can cancel or modify your order (for a product or products) at no cost any time before we send the Completed Order email indicating that your order is complete and being shipped relating to that order, orders, product or products.
Please note that we sell products only in quantities which correspond to the typical needs of an average household. This applies both to the number of products ordered within a single order and the placing of several orders for the same product where the individual orders comprise a quantity typical for a normal household.

Pricing And Availability
We list availability information for products sold by us on the website, including on each product information page. Beyond what we say on that page or otherwise on the website, we cannot be more specific about availability. Please note that dispatch estimates are just that. They are not guaranteed dispatch times and should not be relied upon as such. As we process your order, you will be informed by e-mail or any other means available if any products you order turn out to be unavailable.

Taxes
You shall be responsible for payment of all fees/costs/charges associated with the purchase of products from us and you agree to bear any and all applicable taxes including but not limited to VAT/CST, service tax, GST, duties and cesses etc.
Coupons & Promotions
Any coupons or promotions or discount offers made are subject to change at any time prior to dispatch of goods. All such coupons, promotions and/or discounts, whether time bound or not may be discontinued at any time without prior notice.
Unless otherwise allowed, coupons cannot be used in conjunctions with other coupons.
Unless otherwise allowed, coupons do not apply to items on sale. Per-item coupons will only work if the item is not on sale. Per-cart coupons will only work if there are items in the cart that are not on sale.

Reducing Your Risk
The list below provides guidelines to help reduce the risks linked with using cosmetics.
- Always read warning labels and directions for using cosmetics.
- Before using a new cosmetic product, try a test on a small area of your skin. Wait 24 hours. If there is no reaction, it should be safe to use.When using hair dyes, it is important to do the test each time you use it, even if you haven’t had problems before.
- Never share cosmetics with other people. This could expose you to another person’s bacteria. Also, if your cosmetics dry out, do not dilute them with water or saliva as this can contaminate them.
- A cosmetic labeled ‘hypoallergenic’ can still cause allergic reactions. ‘Hypo’ means less; the cosmetic does not prevent allergic reactions, it is only less likely to cause them.
- Always wash your hands thoroughly before and after putting on make-up.
- Keep your cosmetics away from sunlight and high temperatures. Light and heat can break down the preservatives that keep your cosmetics bacteria-free.
- Never use spray can cosmetics such as hair spray near a flame or source of heat. The heat and flame can react with the cosmetics or hair spray causing an explosion or fire.
- Most cosmetics do not have expiration dates. However, it is recommended to change products like mascara every 3 months to reduce the risk of an eye infection. If you notice a change in the color, odor or texture of a cosmetic, stop using it.
- Keep cosmetic products and toiletries out of the reach of children. If a child swallows any of these products, contact a doctor or emergency room at a hospital near you immediately.
- If you have a bad reaction to any cosmetic, stop using it immediately. Contact your doctor if the reaction is severe or prolonged.

Limitation Of Liability
Except where prohibited by law, in no event will Makeup Stash be liable to you for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits, even if Makeup Stash has been advised of the possibility of such damages.
If, notwithstanding the other provisions of these Terms of Use, Makeup Stash is found to be liable to you for any damage or loss which arises out of or is in any way connected with your use of the Site or any Content, Makeup Stash’s liability shall in no event exceed the greater of (1) the total of any order made in respect of which such claim is made on the date of the initial claim made against Makeup Stash (but not including the purchase price for any Makeup Stash products, or (2) PKR 10,000.00.

You agree to indemnify and hold Makeup Stash, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliates, harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against Makeup Stash by any third party due to or arising out of or in connection with your use of the Site.
You hereby expressly release Makeup Stash and/or its affiliates and/or any of its officers and representatives from any cost, damage, liability or other consequence of any of the actions/inactions of the vendors and specifically waiver any claims or demands that you may have in this behalf under any statute, contract or otherwise.
Children
Use of the Site is available only to persons who can form a legally binding contract under the Contract Act, 1872. If you are a minor i.e. under the age of 18 years, you may use the Site only with the involvement of a parent or guardian. Your continued usage of the Site and placement of any orders implies such involvement of a parent or guardian and includes to mean their consent to the placement of such order or orders.
Communications
When you visit the Site or send e-mails to us, you are communicating with us electronically. You will be required to provide a valid phone number while placing an order with us. We may communicate with you by e-mail, SMS, phone call or by posting notices on the website or by any other mode of communication. For contractual purposes, you consent to receive communications (including transactional, promotional and/or commercial messages), from us with respect to your use of the Site and/or your order placed on the Site.
Losses
We will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that is not reasonably foreseeable to both you and us when you commenced using the Site.
Alteration Of Service Or Amendments To The Conditions
We reserve the right to make changes to our Site, policies, and these terms and conditions at any time. You will be subject to the policies and terms and conditions in force at the time that you use the website or that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.
Events Beyond Our Reasonable Control
We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.
Waiver
If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
Violation Of These Terms Of Use
Makeup Stash may disclose any information we have about you (including your identity) if we determine that such disclosure is necessary in connection with any investigation or complaint regarding your use of the Site, or to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) Makeup Stash’s rights or property, or the rights or property of visitors to or users of the Site, including Makeup Stash’s customers. Makeup Stash reserves the right at all times to disclose any information that Makeup Stash deems necessary to comply with any applicable law, regulation, legal process or governmental request. Makeup Stash also may disclose your information when Makeup Stash determines that applicable law requires or permits such disclosure, including exchanging information with other companies and organizations for fraud protection purposes.
You acknowledge and agree that Makeup Stash may preserve any transmittal or communication by you with Makeup Stash through the Site or any service offered on or through the Site, and may also disclose such data if required to do so by law or Makeup Stash determines that such preservation or disclosure is reasonably necessary to (1) comply with legal process, (2) enforce these Terms of Use, (3) respond to claims that any such data violates the rights of others, or (4) protect the rights, property or personal safety of Makeup Stash, its employees, users of or visitors to the Site, and the public.
You agree that Makeup Stash may, in its sole discretion and without prior notice, terminate your access to the Site and/or block your future access to the Site if we determine that you have violated these Terms of Use or other agreements or guidelines which may be associated with your use of the Site. You also agree that any violation by you of these Terms of Use will constitute an unlawful and unfair business practice, and will cause irreparable harm to Makeup Stash, for which monetary damages would be inadequate, and you consent to Makeup Stash obtaining any injunctive or equitable relief that Makeup Stash deems necessary or appropriate in such circumstances. These remedies are in addition to any other remedies Makeup Stash may have at law or in equity.
You agree that Makeup Stash may, in its sole discretion and without prior notice, terminate your access to the Site, for cause, which includes (but is not limited to) (1) requests by law enforcement or other government agencies, (2) a request by you (self-initiated account deletions), (3) discontinuance or material modification of the Site or any service offered on or through the Site, or (4) unexpected technical issues or problems.
If Makeup Stash does take any legal action against you as a result of your violation of these Terms of Use, Makeup Stash will be entitled to recover from you, and you agree to pay, all reasonable attorneys’ fees and costs of such action, in addition to any other relief granted to Makeup Stash. You agree that Makeup Stash will not be liable to you or to any third party for termination of your access to the Site as a result of any violation of these Terms of Use.
Governing Law; Dispute Resolution
You agree that all matters relating to your access to or use of the Site, including all disputes, will be governed by the laws of the Islamic Republic of Pakistan. You agree to the personal jurisdiction by and venue in the state and federal courts in Lahore, Punjab, and waive any objection to such jurisdiction or venue. Any claim under these terms and conditions must be brought within three (03) months after the cause of action arises, or such claim or cause of action is barred. No recovery may be sought or received for damages other than out-of-pocket expenses, except that the prevailing party will be entitled to costs and attorneys’ fees. In the event of any controversy or dispute between Makeup Stash and you arising out of or in connection with your use of the Site, the parties shall attempt, promptly and in good faith, to resolve any such dispute. If we are unable to resolve any such dispute within a reasonable time (not to exceed thirty (30) days), then either party may submit such controversy or dispute to mediation. If the dispute cannot be resolved through mediation, then the parties shall be free to pursue any right or remedy available to them under applicable law.
Void Where Prohibited
Makeup Stash administers and operates the www.makeupstash.pk Site from its location in Lahore, Punjab, using external hosting services for which Makeup Stash is in no way responsible or liable or purports to make any guarantees; other Makeup Stash sites may be administered and operated from various locations outside the Islamic Republic of Pakistan. Although the Site is accessible worldwide, not all features, products or services discussed, referenced, provided or offered through or on the Site are available to all persons or in all geographic locations, or appropriate or available for use outside the Islamic Republic of Pakistan. Makeup Stash reserves the right to limit, in its sole discretion, the provision and quantity of any feature, product or service to any person or geographic area. Any offer for any feature, product or service made on the Site is void where prohibited. If you choose to access the Site from outside the United States, you do so on your own initiative and you are solely responsible for complying with applicable local laws.
Miscellaneous
You may not use or export or re-export any Content or any copy or adaptation of such Content, or any product or service offered on the Site, in violation of any applicable laws or regulations, including without limitation Islamic Republic of Pakistan export laws and regulations.
If any of the provisions of these Terms of Use are held by a court or other tribunal of competent jurisdiction to be void or unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary and replaced with a valid provision that best embodies the intent of these Terms of Use, so that these Terms of Use shall remain in full force and effect. These Terms of Use constitute the entire agreement between you and Makeup Stash with regard to your use of the Site, and any and all other written or oral agreements or understandings previously existing between you and Makeup Stash with respect to such use are hereby superseded and cancelled. Other than as provided in a purchase agreement you enter into with Makeup Stash, Makeup Stash will not accept any counter-offers to these Terms of Use, and all such offers are hereby categorically rejected. Makeup Stash’s failure to insist on or enforce strict performance of these Terms of Use shall not be construed as a waiver by Makeup Stash of any provision or any right it has to enforce these Terms of Use, nor shall any course of conduct between Makeup Stash and you or any other party be deemed to modify any provision of these Terms of Use. These Terms of Use shall not be interpreted or construed to confer any rights or remedies on any third parties.
Makeup Stash provides access to Makeup Stash international data and, therefore, may contain references or cross references to Makeup Stash products, programs and services that are not announced in your country. Such reference does not imply that Makeup Stash in your country intends to announce such products, programs or services.
